1. Acceptance of these Terms

By accessing or using FanSim, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you are using FanSim on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.

If you do not agree to these Terms, you must not access or use the service.

2. What FanSim is

FanSim is an AI-powered platform that generates synthetic "fan agents" from audience segments and lets you simulate and stress-test launch decisions — including copy, visuals, pricing, and timing — against a statistically modeled fan population. It also provides fandom intelligence, focus-group style reactions, and related analytics.

FanSim is currently offered to a limited group of partners, on an invitation basis, and may change as the product evolves.

3. Accounts & eligibility

You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account.

You must be at least 18 years old, or the age of majority in your jurisdiction, and legally able to enter into these Terms, to use FanSim.

4. Acceptable use

You agree not to misuse FanSim. In particular, you will not: use the service for any unlawful purpose; attempt to reverse engineer, scrape, or disrupt the platform; upload content you do not have the rights to use; infringe the rights of any individual or third party; attempt to re-identify, impersonate, or harass real people using synthetic outputs; or use the service to generate deceptive, defamatory, or harmful material.

We may suspend or restrict access if we reasonably believe your use violates these Terms or creates risk for us, our partners, or others.

5. AI-generated content disclaimer

The simulations, "fan agents", focus-group reactions, and other outputs produced by FanSim are synthetic and AI-generated. They do not represent real individuals, and any resemblance to a specific real person is unintended.

Outputs are statistical predictions and estimates — not guarantees of real-world behavior or outcomes. You should treat them as one input among many. Do not rely on FanSim outputs as the sole basis for any business, financial, creative, or other decision. You remain solely responsible for the decisions you make.

6. Subscriptions, tokens & billing

Access to certain features may require a paid subscription or the consumption of tokens or credits. Pricing, plans, and token allowances are described in the product or in a separate order or agreement with you.

Unless stated otherwise, fees are non-refundable, subscriptions renew for successive periods until cancelled, and unused tokens or credits may expire. We may change pricing on a prospective basis with reasonable notice.

7. Intellectual property

FanSim, including its software, models, design, and underlying methodology, is owned by bemyfriends and its licensors and is protected by intellectual-property laws. These Terms do not transfer any ownership in the platform to you.

You retain ownership of the content you upload (for example, your audience data, research, and brand materials). You grant us a limited license to host, process, and use that content solely to provide and improve the service for you. Subject to your rights in your input, outputs generated for you may be used by you for your business purposes.

8. Confidentiality

Each party may receive non-public information from the other. The receiving party will protect such confidential information with reasonable care, use it only to perform under these Terms, and not disclose it except to personnel and service providers bound by similar obligations, or as required by law.

9. Disclaimer of warranties

FanSim is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that outputs will be accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, neither bemyfriends nor its affiliates will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of FanSim.

To the maximum extent permitted by law, our total aggregate liability arising out of or related to these Terms will not exceed the amounts you paid to us for the service in the twelve months preceding the event giving rise to the claim.

11. Termination

You may stop using FanSim and delete your account at any time from Settings. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. Provisions that by their nature should survive termination — including intellectual property, confidentiality, disclaimers, and limitations of liability — will survive.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will take reasonable steps to notify you, for example by posting an updated version with a new "Last updated" date. Your continued use of FanSim after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws rules. The courts located in the Republic of Korea will have jurisdiction over any dispute, except where mandatory law provides otherwise.
