DMCA Copyright Policy

bemyfriends, Inc. ("bemyfriends," "we," "us") respects the intellectual property rights of others and expects users of Fansim (the "Service") to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent as described below.

1. Reporting Copyright Infringement

If you believe that content hosted on or accessible through the Service infringes your copyright, you may submit a written notification to our designated DMCA agent. Your notification must include the following information:

  • Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, you may provide a representative list.
  • Identification of the material you claim is infringing, including sufficient information to allow us to locate it on the Service (such as a URL or description of where it appears).
  • Your contact information, including your full legal name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature (or the signature of a person authorized to act on behalf of the copyright owner).

2. Designated DMCA Agent

You may also reach the DMCA agent through our contact page. Please include "DMCA Notice" in the subject line to ensure prompt handling.

3. Counter-Notification

If you believe that material you posted on the Service was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include:

  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your full legal name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which bemyfriends, Inc. may be found, including the federal district courts of the State of California) and that you will accept service of process from the person who filed the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.

4. Processing of Notices

Upon receipt of a valid DMCA notification, we will act expeditiously to remove or disable access to the allegedly infringing material. We will make a good-faith attempt to notify the user who posted the content so that they may submit a counter-notification if they believe the removal was in error.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action seeking to restrain the allegedly infringing activity within ten (10) business days, we may restore the removed material.

5. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We may also, at our sole discretion, limit access to the Service or terminate the account of any user who infringes the intellectual property rights of others, regardless of whether there is any repeat infringement.

6. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.
